شرط داوری استاندارد

«تمامی اختلافات و دعاوی ناشی از، راجع و یا مرتبط به این قرارداد از جمله دعاوی و اختلافات مربوط به مذاکرات مقدماتی، انعقاد، اعتبار، فسخ، نقض، تفسیر، اجرا یا عدم اجرای آن منحصرا به دفتر مرکز داوری اتاق بازرگانی، صنایع، معادن و کشاورزی تهران (مرکز اتاق تهران) ارجاع می‌شود تا بر اساس قواعد داوری مورد عمل این مرکز که با درج این شرط به منزله توافق صریح طرفین تلقی می‌شود، با رای یک داور/سه داور به صورت قطعی و لازم الاجرا حل و فصل گردد.

داور علاوه بر مقررات حاکم، عرف تجاری ذیربط را نیز مراعات خواهد نمود و این شرط داوری موافقتنامه‌ای مستقل از قرارداد اصلی است و بطلان، انحلال، خاتمه، انفساخ، فسخ یا بی اعتبار شدن قرارداد اصلی تاثیری بر اعتبار و قابلیت استناد به این شرط ندارد.»

English Translation of the TCCAC Arbitration Clause

Any dispute arising out of or in connection with this contract, including but not limited to preliminary negotiations, existence, validity, termination, breach, and interpretation of the contract, shall be referred to the Tehran Chamber of Commerce Arbitration Centre (TCCAC) and resolved by one or three arbitrators, under the Arbitration Rules of the Iran Chamber of Commerce Arbitration Centre (ACIC), and the award shall be final and binding.

Considering the importance of the case, the number of arbitrators shall be one or three at the TCCAC's discretion as the appointing authority.

The arbitrator(s) shall, in addition to the governing law of the contract, observe the relevant trade customs.

This arbitration clause is considered independent from the main contract and remains valid and binding in any case such as invalidity, termination, or dissolution of the main contract.
